Briefings

The Portuguese Socialist Party (PS) plans to file a constitutional complaint against the government's new Criminal Procedure Code (CPP) amendments, which limit defense rights and increase procedural speed. The PS argues seven articles violate the Constitution, citing the President's July promulgation of two decrees that justify these changes as necessary for judicial efficiency. Isabel Moreira, the complaint author, highlights risks such as admitting guilty pleas without evidence and imposing fines on lawyers for ineffective defense. The case is pending before the Tribunal Constitucional, with the government defending the reforms as steps toward justice.
