Briefings

OpenAI announced in November 2026 that it will no longer use non-disclosure agreements (NDAs) with public officials for data center projects, shifting to narrow protections for legitimate security, trade secrets, and proprietary information. This follows midterms where voters opposed data center expansion, and Amazon previously halted similar projects. The move aims to address scrutiny over NDAs hiding developer-official discussions.

Key points

• OpenAI will not use non-disclosure agreements (NDAs) with public officials for data center projects, limiting protections to legitimate security, trade secrets, and proprietary information.
• This change follows midterms where voters resoundingly opposed data center expansion, and Amazon previously announced it would halt similar projects in October.

Context

OpenAI is working on data center projects in communities where it operates. Many data center projects have faced scrutiny for relying on NDAs to hide discussions between developers and local officials. OpenAI's new policy aims to address this by allowing only narrow protections covering specific sensitive information types.

Limitations

Evidence is limited to OpenAI's announcement in November 2026 regarding NDAs with public officials. Specific locations of projects, exact community impacts, or long-term consequences are not detailed in the provided text.
